Official Rules and Regulations

OPEN TO ALL DEVELOPERS

  1. Contest Period: The contest will run from 12:00:01 a.m. on October 1, 2006 to 12:00:00 a.m. on March 31, 2007 (the “Contest Period”). All times are Pacific Standard Time unless otherwise specified.
  2. Definition of an Entrant: For the purposes of this contest, an entrant will be defined as the Developer of any J2ME game (Product) entered into and accepted by the MobileRated portal during the Contest Period.
  3. Eligibility: Any Developer of J2ME games entered into and accepted by the MobileRated portal during the Contest Period is automatically eligible. Employees, agents and representatives of MobileRated (“Sponsor”), their affiliated companies, representatives, agents advertising and promotional agencies, or the contest judges (collectively, “Contest Sponsors”), and persons domiciled with any of such employees, agents or representatives, are not eligible to enter.
  4. Contest Outcome: The Top Product, as determined by total number of unique user downloads over a contiguous 30-day period within the Contest Period, as determined by MobileRated at its sole discretion, shall be offered a non-exclusive contract for continued distribution of their product on the MobileRated portal in the amount of $500 Canadian. Once per month, at MobileRated’s sole discretion, the top three products for the prior 30 days, shall be revealed on the MobileRated portal, for entertainment value only.
  5. Chance of Being Declared Top Product: The chance of being the Top Product in the contest depends on the number of eligible entrants and products and each entrant’s product’s overall unique user downloads in the contest.
  6. General Rules:
    1. The Top Product contract must be accepted or declined as is. There will be no substitution, exchange or return by a Top Product Entrant.
    2. Contest Sponsors are not liable for any defects in the Products that may limit an individual’s ability to participate in the contest. All product downloads that are late, incomplete, damaged, destroyed, lost, undeliverable, misdirected, garbled, irregular, duplicates to a single user, have been played through illicit means, or do not conform to these rules, may be disregarded by Sponsor.
    3. Entrants must comply with these rules, and will be deemed to have read and understood the rules if they have participated in the contest. By entering, entrants agree to release and hold harmless Contest Sponsors from any and all liability, injuries, loss or damage of any kind arising from their participation in the contest or the acceptance or use of the distribution contract. In particular, without limitation, Contest Sponsors are not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entry into the contest, including from downloading material associated with this contest.
    4. By entering the contest, all entrants agree to the use by Sponsor of their name, address, likeness and photo for any advertising, publicity and marketing purposes, without compensation, if they are confirmed as owners of the Top Product.
    5. This contest is subject to all federal, provincial and municipal laws. The contest is void where prohibited.
    6. Any individual who is an employee, representative or agent of Contest Sponsors, or domiciled with, such an employee, representative or agent, is prohibited from assisting contest entrants in any way during the Contest Period.
    7. The terms and conditions of this contest as set out in these rules, are not subject to amendment or counter offer, except as set out herein.
  7. Determining the Top Product:
    1. On or before April 15, 2007 MobileRated will announce the Top Product. The Top Product is the product that was successfully downloaded to unique users the most times over a 30-day period within the Contest Period as calculated by MobileRated at its sole discretion.
    2. Starting April 15, 2007, five (5) attempts will be made to contact the entrants who are eligible to claim the distribution contract at the email address of the Entrant. If after five (5) business days, any of these entrants cannot be contacted, he/she is no longer eligible for the distribution contract, and will not receive a distribution contract. The decisions of the contest judges will be final and binding on all entrants.
